Graham Museum Copyright Policy

Users of the Graham Museum’s collections are expected to comply with all copyright and intellectual property laws. The Graham Museum does not hold copyright for all materials in its collections. Due to the nature of historical collections, determining copyright status or other usage restrictions may be challenging or impossible. The absence of copyright or restriction information does not guarantee that a work is in the public domain, either in the United States or internationally. Researchers bear the responsibility of determining and adhering to copyright and any other restrictions. The Graham Museum makes no express or implied warranty to those wishing to use or reproduce items found in its collections. Additionally, materials from the Graham Museum’s collections may be subject to privacy, publicity, and trademark rights.

Public Domain Materials no longer protected by copyright are in the public domain and may be freely used without permission. The Graham Museum does not charge fees for the use of public domain materials, nor does it grant or deny permission for their use. Fair Use Sections 107 and 108 of U.S. Copyright Law allow for the use and duplication of copyrighted works without permission for purposes such as criticism, commentary, news reporting, teaching, scholarship, or research. The Graham Museum encourages “fair use” of its materials whenever applicable. Researchers should keep a record of their fair use determinations or any efforts to secure permissions.

Digitization Services The Graham Museum offers reproduction services for materials in its collections for research, personal, educational, creative, or commercial use. For high-resolution reproductions, researchers can contact the museum for assistance. Fees associated with reproductions cover labor for research, retrieval, equipment setup, handling, metadata creation, and delivery. Any use of reproductions beyond fair use, such as redistributing or altering materials, requires permission from the copyright holder. Researchers are responsible for determining copyright status and securing permissions for reuse of Graham Museum materials.
